Bad quality Scooter

Is so sad to start having problems with it after 3 months of purchase. No options for repair are provided and is very difficult to find someone who can fix it. Disappointed

06/09/26 sent this email to Edward and file dispute with Bank of America Dear Edward, This is totally unacceptable. When I purchased the first unit I was given 30 days to return the unit for a full refund if it did not meet my expectations. That unit was defective and not operational after two weeks and you had me hold onto the unit because you were sending out a service rep to fix the unit. That rep never arrived at my house and after 2 weeks you sent me a second unit that failed to work after only one week in my possession as evidenced by the video I sent to you showing you it was not working. If it’s not working, how can you claim it is not defective. I want this Jazzy returned for a full refund because you denied me the opportunity to return the first unit within the allocated 30 days time, the rep who you promised would be coming to my home to fix the first unit never arrived, and the second unit you sent to me stopped working after one week. Based on these experiences, how can you in good conscience now tell me there will be a 20% restocking fee and that I will be responsible for the shipping due to the unit not being defective. ——— On 06/10/26 Edward Canlas sent me the following email: On Jun 10, 2026, at 9:13 AM, Edward Canlas wrote: Hi Christopher, I understand where you are coming from.  Returns are eligible within 30 days of receiving your product. If your product is working fine, but you justdon’t want it, you will be subject to a 20% restocking fee, and you are required to ship it back to us with theoriginal packaging. Please view our return policy below ***www.mobilityscootersdirect.***/return-policy The first issue with the defective unit was resolved by replacing it with a new unit. The experience you had was not a defect of the unit. It is a feature for safety precautions.   Thank you, and have a great day. Regards, Edward ——————- On 06/10/26 I responded with the following email: Dear Edward, I am writing to formally reject your assessment of this situation and your attempt to charge me a 20% restocking fee and return shipping costs. Your email states: "If your product is working fine, but you just don’t want it, you will be subject to a 20% restocking fee. " To be entirely clear, this product is not working fine.  This is not a case of buyer's remorse; this is a mechanical failure of a vital medical device. Please note the following facts regarding this order: 1 Continuous Claim: I legally initiated my original complaint and return request well within the 30-day window after the first unit arrived defective. The replacement unit you provided failed completely within one week of delivery. This is a continuation of my original claim for a defective product, not a brand-new "buyer's remorse" return. 2 Breach of Implied Warranty: Under consumer protection laws, consumer goods carry an Implied Warranty of Merchantability. A power wheelchair that becomes non-operational after seven days of normal use is inherently defective and unfit for its intended purpose. 3 Rejection of "Safety Feature" Claim: Your claim that a non-functional wheelchair is simply a "safety feature" is entirely unacceptable. A safety feature does not disable a mobility device and leave a customer stranded. If the unit requires a technician to function—and your company failed to send one as previously promised—the unit is defective. Because Mobility Direct has failed to provide a working product after two attempts, I am requesting a 100% full refund to my original form of payment and a prepaid freight shipping label (or coordinated freight pickup) to return this defective item. I will not bear the financial burden for your defective inventory. If Mobility Direct refuses to waive these fees and issue a full refund within 48 business hours, I will take the following immediate steps:  Credit Card Dispute: I will initiate a formal chargeback with my financial institution for "Product Defective / Not as Described. " This email chain, along with the documentation of the first failed unit and your refusal to cover return shipping for a broken device, will be provided as evidence.  Regulatory Complaints: I will file formal consumer complaints with the Better Business Bureau (BBB) and the Florida Attorney General’s Office for unfair and deceptive business practices regarding medical equipment.  Manufacturer Escalation:I will contact Pride Mobility corporate directly to report that an authorized dealer is penalizing a consumer for successive factory defects on their Jazzy line. I expect your immediate cooperation in sending the necessary paperwork for a full, unpenalized return. Sincerely, Christopher Falconer  973. 452. 9869
